GENERAL

The use of this site is governed by the TERMS AND CONDITIONS AGREEMENT OF SALE set forth below. Your use of this site or purchase from JB Homes Pty Ltd trading as Booby Bibs (hereinafter referred to as “Booby Bibs”) indicates your acceptance of these terms and conditions. All sales, whether internet based or in store are subject to these terms and conditions. It is important you read and fully understand this document at the time of purchase.

Booby Bibs reserves the right to make changes to this web site and these terms and conditions at any time without any prior notice.

PLACING ORDERS

Not all items displayed on this website are kept in stock. Although we carry a very large stock holding it is not possible to stock every single item. In this case an ETA (estimated time of arrival) will be made available to you.
All prices listed on the web site are for internet mail orders only. A surcharge may apply for internet specials to any walk-in customer who has not placed an order on-line prior to the pick-up of that order. If more than one garment is purchased in any order, then a discount of 5% will be given for any second garment and a 10% discount for any third or subsequent garments purchased.
Any attempt to cancel an order must be made before dispatch. Cancellations attempted after the dispatching will result in the customer having to pay the shipping and handling charges on the package and the cost of shipping the package back.
Cancellations for completed garments will incur a $10.00 cancellation fee.

PAYMENT

For on-line orders we recommend and prefer direct deposit, bank transfer or cheque, mail order or personal cheque. GST is included in our pricing. Payment can also be made for on-line orders via credit card but this is subject to approval by sales person.
Dispatching of goods where the payment terms selected is by pre-payment, is subject to fund clearance. This includes direct deposits, payment by cheque etc.
For pick up order, payment can be made by accepted credit cards, EFTPOS, direct bank deposit, cash, money order, cheque (this must be approved by Booby Bibs and appropriate identification provided). Cash deposit and fund transfer requires overnight for the fund to be cleared. Cheque deposit will take 3 or 4 days to be cleared.

There may be an additional surcharge for using credit card depending on the garment concerned. Please ensure you are informed of the total cost before accepting an order.
Booby Bibs offers a COD delivery service. COD services within the Melbourne area are provided through our own delivery service.
All Direct Deposits for Internet sales are not refundable.
When doing a direct fund transfer or direct deposit into our account, please include your name, order number or product name as the deposit Reference. It is also required for a deposit slip to be sent to us by fax or E-mail (scanned). For Internet funds transfer please cut and paste the transfer details and send to us by E-mail.
Our bank account details will be provided upon request.

SHIPPING

We do not ship to third party addresses unless that address is known and can be verified by Booby Bibs.
Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods. Booby Bibs will make every effort to deliver on time. However, we shall not be held liable for delay or lost shipment.

RETURN & REFUND

There will be no credit given on order price difference, due to price drops. Please select carefully at the time when you place your order.
Returns for refund will only be accepted within 10 days of you receiving the goods. Returned goods must be in its original condition and include all the original packaging with tags attached. Anything which is not sealed must be replaced at the customer’s expense. Shipping and handling cost are not refundable. If Booby Bibs agrees to a monetary refund for a garment, it shall provide the same within 30 days of the garments return to it.
Any incorrect, missing or damaged items received must be reported to Booby Bibs within 24 hours of you receiving the delivery.
If item(s) received is not what was ordered please do not open the sealed package in which it was sent. Any attempt to use the incorrect item will be deemed to be acceptance by the customer of the item(s) as a satisfactory substitute for the one that was ordered and no further claim can be raised thereafter.
Booby Bibs owns the title of any extra goods shipped with your order that have been dispatched in error.

WARRANTY CLAIM

All goods sold by Booby Bibs come with a thirty (30) day warranty, which warranty is not transferable and any garments under warranty may at Booby Bibs discretion be replaced, repaired or a refund provided.
Warranty only covers the item(s) sold by Booby Bibs.
Booby Bibs does not handle warranty claim for those goods where the manufacturer accepts direct warranty claims from customers.
All warranties are voided if the returned garment is considered by Booby Bibs to be damaged in a manner inconsistent with its use.
Please attach a copy of the original invoice or provide the original invoice number.
A detailed fault description sheet must be sent together with all the returned warranty goods.
Customers coming back to collect garments from warranty must provide the original warranty form that was given at the time the product was purchased.
Customers are responsible for proper packaging of returned garments and all warranties will be voided on garments that are insufficiently or inaccurately packaged. Customers will be responsible for all the shipping charges associated with returning the defective garments, provided however that where the manufacturer accepts direct warranty claims Booby Bibs shall be responsible for the shipping charges referred to herein.
Customers are responsible for any shipping or insurance cost involved in sending the warranty claim garments back to Booby Bibs and Booby Bibs is not responsible for any parcel missing in transit, on its return back to it.
Product(s) discontinued by Booby Bibs shall be replaced by a similar product or a credit will be given at the current market value or the purchase price whichever is lower.

DISCLAIMER

Due to changing market forces and other extenuating circumstances that affect product availability, and price stability we reserve the right to withdraw any product we advertise and change prices without notice.
Information contained throughout the web pages and in our database is believed to be accurate and reliable at the time of publishing. There may be misprints, human errors, and omissions. We reserve the right to make changes and corrections in prices, products, and specifications without notice.

All trademarks, service marks and trade names employed by Booby Bibs are its absolute property or any other respective owners that have granted Booby Bibs the right and license to use such trademarks, service marks and trade names. Without express written consent, Booby Bibs’ trademarks, service marks and trade names may not be used in connection with any product or service that is not Booby Bibs’ and in any manner that is likely to cause confusion amongst our customers or in any manner that disparages or discredits Booby Bibs to the extent that you have or in any manner violated or threatened to violate Booby Bibs’ intellectual property rights, Booby Bibs may seek an injunction or other appropriate relief in any state or federal court in Australia and you consent to exclusive jurisdiction and venue in such courts.
